Infamous former FBI Director James Comey pleaded not guilty to the recently brought charges of making false statements and obstructing a congressional investigation in 2020. Now, with jail time on the line for him, his lawyers are scrambling in a desperate move to keep him out of jail or have the case dismissed.
To do so, his lawyers filed motions to dismiss, desperately alleging vindictive prosecution driven by President Trump’s personal dislike for James Comey, and pointing to retaliation for the investigation into Russian collusion in the 2016 election.
Similarly, the lawyers complained that Trump’s decision to appoint acting U.S. Attorney Lindsey Halligan rendered the indictment invalid. Based on these points, the attorneys seek dismissal with prejudice; the defense also demands discovery to probe prosecutorial decisions.
In any case, as their meltdown began, Comey’s lawyers started by lobbing baseless allegations at President Trump. “President Trump ordered the Department of Justice to prosecute Mr. Comey because of personal spite and because Mr. Comey has frequently criticized the president for his conduct in office,” the motion read.
Still not done, the defense pivoted to the theatrical language, arguing, “The indictment in this case arises from multiple glaring constitutional violations and an egregious abuse of power by the federal government. When no career prosecutor would carry out those orders, the president publicly forced the interim U.S. attorney to resign and directed the Attorney General to effectuate ‘justice’ against Mr. Comey.”
Finally, wrapping up this lengthy filing, Comey’s legal team begged the judge to dismiss the suit over the claims of vindictive prosecution. “Because of that fundamental constitutional and statutory defect, the indictment is a nullity and must be dismissed,” the lawyers begged the court.
Coming off as pushy and demanding, the same document alleged, “The proper remedy for this unconstitutional prosecution is dismissal with prejudice… Any lesser remedy would be insufficient in light of the government’s flagrant misconduct and the need to deter the government from bringing further unconstitutional prosecutions.”
Concluding the letter, the former FBI director’s lawyers said, “Objective evidence establishes that President Trump directed the prosecution of Mr. Comey in retaliation for Mr. Comey’s public criticisms and to punish Mr. Comey because of personal spite.”
As we reported in the American Tribune, after he was indicted for false statements and obstruction tied to 2016 Russia probe lies, James comey issued a breatheless statment which made him look even more guilty, “My family and I have known for years that there are costs to standing up to Donald Trump, but we couldn’t imagine ourselves living any other way,” the biased former FBI director said.
Doubling down on theatrical rhetoric, Comey whined, “We will not live on our knees, and you shouldn’t either. Somebody that I love dearly recently said that fear is the tool of a tyrant, and she’s right, but I’m not afraid, and I hope you’re not either.”
Concluding his comments, the self-indulgent FBI official said, “I hope instead you are engaged, you are paying attention, and you will vote like your beloved country depends upon it, which it does. My heart is broken for the Department of Justice, but I have great confidence in the federal judicial system, and I’m innocent, so let’s have a trial and keep the faith.”
